Acceptance

By installing or using the TrainWake Android app (the “App”), you agree to these terms. If you don’t agree, don’t install the App.

Don’t rely on the App alone for safety-critical wake-ups

TrainWake is a convenience alarm. GPS reception, battery state, OS background limits, and your phone’s sound settings can all prevent the alarm from firing on time. If missing your stop would have serious consequences, set a second independent alarm.

Licence

Smith Built Concepts Pty Ltd grants you a non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial use. You may not redistribute, modify, reverse-engineer (except where local law permits) or commercially exploit the App.

No warranty

The App is provided “as is” without warranty of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement. To the maximum extent permitted by law, Smith Built Concepts Pty Ltd will not be liable for any damages arising from your use of the App, including any missed stop, missed connection, or missed appointment.

Nothing in these terms excludes any rights you have under the Australian Consumer Law that cannot lawfully be excluded.

Third-party services

The App uses Google Play Services on-device and fetches map tiles from OpenStreetMap. Your use of those services is governed by their own terms.

Changes

We may update these terms from time to time. Continued use of the App after a change constitutes acceptance of the updated terms.

Governing law

These terms are governed by the laws of Queensland, Australia. Disputes will be heard in the courts of that jurisdiction.
